TicknClick Terms and Conditions
Operator: Cold Boot Ltd (“we”, “us”). Effective date: 22 October 2026. Last reviewed: 22 October 2026.
1. About these terms
These terms govern your access to TicknClick at ticknoflick.com and its account, marking, export and related features. By creating an account or using the service, you agree to them. If you use TicknClick for a school or other organisation, you confirm you are authorised to bind it to these terms; references to “you” include that organisation where appropriate. Separate written terms will take priority where they expressly cover the same subject.

2. What the service does
TicknClick currently uses the OpenAI API to produce draft marks and feedback against the mark scheme supplied with student work. It can process scanned or handwritten PDFs and supported digital text documents. It can flag some responses where the AI reports uncertainty, provide question-level feedback and, when essay marking is selected, paragraph comments. Teachers can review and edit the suggestions and export marks, percentages and individual feedback documents. Further details about AI-provider processing are in the Privacy Policy.
The service assists marking; it does not replace teacher judgement. AI can misunderstand handwriting, omit relevant context, apply a scheme incorrectly, produce biased or incomplete feedback, or fail to flag an error. A teacher must compare every submission, suggested mark and feedback with the work and mark scheme, correct errors, and approve results before finalisation or sharing. Do not use automated suggestions alone to determine a pupil’s grade, placement, access to opportunity or other significant educational outcome.
The service is provided as currently available and may change. We do not promise uninterrupted availability, error-free marking, a particular educational result, a particular provider response time or a particular percentage of correct marks. Nothing in these terms excludes your statutory rights or our responsibility to provide the service with reasonable care and skill where the law requires it.
3. Accounts and acceptable use
You must give accurate account information, keep credentials confidential, use your own account and tell us promptly about suspected account compromise. Signup currently requires an invite code. We may refuse, suspend or close access where reasonably necessary to protect users, investigate fraud, comply with law, address a material breach or maintain service security. Where practicable, we will explain the reason and allow a reasonable opportunity to correct a problem. You may stop using the service and ask to close your account through the support contact.
You must only upload information you are authorised to use and disclose. Do not upload unlawful content, malicious files, passwords, special-category information unless specifically assessed and authorised, or information that is unnecessary to mark the work. Do not attempt to access another user’s data, disrupt the service, reverse engineer it except where law permits, or use outputs to mislead, discriminate unlawfully or make unreviewed high-impact decisions.
4. School and student information
You decide which work to upload, the purpose of marking and how results are used. You are responsible for having authority and a lawful basis to upload student work, giving appropriate privacy information, complying with school policies, removing unnecessary identifiers and checking the provider and processing arrangements. Where you act for a school, you must have its authority and ensure the school’s data-protection requirements are met.
We process student work to provide the marking service under your instructions as described in the Privacy Policy and, where required, a data-processing agreement. We may use submitted work, mark schemes, outputs and teacher corrections for TicknClick service improvement, including training or fine-tuning models for this service, only subject to the conditions in the Privacy Policy and any separate written school/customer agreement. No such use is authorised merely because you accept these terms or upload a paper. Identifiable student material will not be used for that purpose until a valid lawful basis, clear notice and any required express school authorisation are documented. We will not sell student work, use it for advertising or permit an AI provider to use it for its own model training.
You must review all AI outputs before sharing them with students. You are responsible for decisions about marks, grades, reports, teaching and student communications. Do not present AI-generated feedback as infallible or as a teacher’s checked judgement when it has not been checked.
5. Credits, prices and payments
There is no subscription. The service is currently available by invite and paid checkout is not open. When purchases are enabled, credits will be sold in packs and used to process marking sets. Prices, currency, credit quantities, any applicable VAT, payment terms and any expiry rules will be shown before purchase. The required credit amount depends on the upload, including the number of submissions, marked pages and essay setting. The upload screen displays the quote before submission. Do not submit if the quote is not clear.
Payment is processed by Stripe. We do not store full card details. A credit balance and transaction history are kept to administer the service and resolve payment questions. Credits cannot be transferred or redeemed for cash except where required by law. We will not introduce a recurring charge without your express agreement. Statutory cancellation and refund rights remain unaffected. Before any paid sale, the purchase screen will show the full price and the applicable payment, cancellation and refund information.
6. Submitted materials and intellectual property
You and your school retain rights in uploaded work, mark schemes and your content. You give us a limited, non-exclusive permission to host, copy, transmit and process it only as needed to provide, secure and support the service, and for the conditional improvement use described in section 4 when separately authorised and lawful. This permission ends when the relevant content is deleted, subject to lawful retention and backups.
We own TicknClick, its software, design, branding and documentation. We grant you a limited, non-transferable right to use the service for your teaching or authorised organisational purposes while your account remains active. Do not copy or resell the service or remove ownership notices.
7. Exports and responsibility
You are responsible for checking exported spreadsheets and Word documents, protecting them after download, and sharing them only with the intended recipients. Spreadsheet exports include marks and percentages; Word documents may contain individual student feedback. Keep downloaded files in an appropriately protected school location and delete local copies when no longer needed.
8. Availability, changes and suspension
We may update, maintain or temporarily suspend the service for security, legal, technical or operational reasons. We will try to give advance notice of material planned interruptions when reasonably possible. We may change features, supported formats or providers and will update relevant information. If a material change substantially reduces a paid feature you have purchased, contact us to discuss an appropriate remedy, subject to applicable law.
9. Liability
Nothing in these terms limits or excludes liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or applicable consumer rights. If you are a consumer, mandatory consumer law continues to apply.
Subject to that, we are not responsible for loss caused by your failure to review AI suggestions, your lack of authority or legal basis to upload student data, inaccurate inputs, misuse of results, failure to maintain your own exports or backups, or third-party systems outside our reasonable control. We are not responsible for indirect loss that was not reasonably foreseeable when the contract was formed. If you use the service in the course of business, our total liability for all claims arising in any rolling 12-month period is limited to the greater of £100 or the amount you paid us in that period. This limit does not apply where prohibited by law and must be reviewed for fairness and appropriateness before use.
10. Privacy, security and retention
Our Privacy Policy explains how information is used and retained. You must not rely on TicknClick as the only copy of records you need. We use security measures but cannot guarantee that an online service is completely secure. Tell us promptly if you identify a security or privacy concern.
11. Complaints and contact
Contact j.k.dingsdale@gmail.com with account, service, refund or complaint questions. We will try to resolve concerns promptly and fairly. Data-protection requests can be sent to the privacy contact in the Privacy Policy.
12. Governing law
These terms are governed by the law of England and Wales, except where mandatory consumer protections require another law to apply. Courts with jurisdiction under applicable law may hear disputes; nothing here removes a consumer’s right to bring proceedings in a competent local court.
13. Changes and entire agreement
We may revise these terms by posting a new version with an updated date. We will give reasonable notice of material changes and ask for renewed agreement where the law requires. If one provision is unenforceable, the remaining provisions continue to apply. These terms and any applicable written data-processing agreement form the agreement for use of the service.
